Railroad Safety and Federal Regulation Consultant. Mr. Farrell began his railroad career as a Police Officer in 1969 investigating accident and security related cases on Penn Central Railroad. Having been laid off, he was eventually transferred to the Mechanical Department. He rose rapidly and was promoted to Mechanical Foreman and Relief Wreck Master at Newark, N.J. As Wreck Master, he investigated most accidents on what was Conrail and is now CSX and Norfolk Southern Railroad systems.

In 1978 he became General Chairman of the Penn Central local of the Americal Railway and Airway Supervisors Association (ARSA). In 1979 he became the Vice General Chairman of all merged railroads. He was also elected as a Trustee of the International Section of ARSA.

He is an expert witness on railroad accidents, injury investigations and interpretation of Federal Railroad Administration Rules and Regulations. Mr. Farrell was a Railroad Safety Inspector for 14 years, experienced in most FRA safety disciplines with special expertise in Motive, Power and Equipment. He has acted as Inspector in Charge at major train accident investigations and determined causal factors and failures. He has worked as Team Leader with the NTSB on several major accidents. He has received several achievement and team awards for his contributions to safety in the railroad industry. He is proficient in evaluation of event recorders on railroad equipment and newly installed automotive recording devices.

Mr. Farrell has attended 24 selected training courses during his government career at the Department of Defense as a brakeman and locomotive engineer and with the Federal Railroad Administration to enhance his ability and duties as an FRA accident investigator and has received more than the average training on accident investigations. He has extensive knowledge of both passenger and freight train operations. Mr. Farrell is available to assist railroads on compliance issues with federal regulations and laws. He is also available to assist attorneys, labor unions and railroad employees on litigation issues such as personal injury reporting and is very proficient in personal injury investigations, train and rail/highway grade crossing accidents. Hired on the New York Susquehanna and Western Railway as a Track Laborer in early 1993, was then promoted to Timekeeper in Mid 1993. In late 1993 hired on with the Mohawk Adirondack and Northern as a Conductor, then promoted to Engineer in early 1994. In mid 1994, hired on with New York Susquehanna and Western as a Engineer/Conductor operating freight trains between Binghamton NY and Little Ferry NJ.  In Mid 1995 hired out with the Wisconsin Central LTD, working out of Fond du Lac Wisconsin. Operated freight trains to Stevens Point, Green Bay and Chicago Illinois. In Chicago operated on all the Major Carrier routes. While employed with WC, qualified on NORAC,GCOR,CSX,NS,BRC operating rules. 1999-2007 returned to New York Susquehanna and Western Railway as a Locomotive Engineer working out of Syracuse NY, operating freight trains between Syracuse and Binghamton NY. While in Syracuse I worked into Dewitt yard (CSX) to handle interchange traffic. In 2001 I was given the title of DSLE for the Railroad. Responsibilities included training, annual monitoring, Rules Examiner re certification. I was also involved in the day to day operations concerning train movements, updating of Timetable and monitoring in the application of applying rules. I have been a FRA Certified Locomotive Engineer since 1994 and specialize in the following areas, train handling, operating rules, Federal Code of Regulations, engineer certification, train crew issues.

Expert knowledge of data downloaded from locomotive event recorders and the analysis of such data to determine causation of railroad accidents/incidents.  Dedicated to supporting litigation counsel through investigation and providing consultation and expertise. Will attend and assist attorneys during questioning of opposing parties during depositions. Investigated derailments, crossing accidents, personal injuries and other circumstances involving the rail industry. Given opinions in hundreds of railroad accidents/incidents. Mr. Fulk has demonstrated expertise while giving opinions and testimony for plaintiff and defendant attorneys during litigation of FELA and crossing accidents. Opinions and testimony has been given for offshore shipping company disputes over damage to laden and/or derailment causation. Retained by South Coast Air Quality Management District, (SCAQMD), an agency of the California Air Resources Board, (CARB), and provided expert testimony during court proceedings concerning railroads application of proposed rules requiring railroads to shut down locomotives to control diesel engine emission out-put.

Mr. Fulk has 33 years experience as Brakeman, Conductor, Fireman, Locomotive Engineer, (freight, local, yard, and passenger service), District Road Foreman and Division Road Foreman of Engines on the Norfolk Southern Railway. While employed by Norfolk Southern, was responsible for training programs and supervision of train and engine employees. Currently a Class 1 Certified Locomotive Engineer. Member of National Association of Railroad Safety Consultants and Investigators, (NARSCI), American National Standards Institute, (ANSI) – Committee A10.36, and Air Brake Association. Awarded Amtrak’s Engine Service Excellence Award while serving as locomotive engineer, 1994 – 2005. Amtrak tenure included, interim management, classes at the Chicago Illinois Institute of Technology, taught Amtrak engineers train braking methods, graduated release versus direct release braking, during classroom and on-board instruction.

Mr. Fulk earned a diploma from the Railway Educational Bureau in 2006 after completing over 50 lessons in assorted railroad subject matter. Past member of BLE Safety Task Force, organized for the purpose of participating in accident investigations conducted by the National Transportation Safety Board, (NTSB).
